Barry Glaser’s practice focuses on creditors’ rights, insolvency and mediation regarding 9th circuit and Bankruptcy Court related matters. His extensive experience includes the representation of creditors (secured and unsecured), and creditors’ committees. Mr. Glaser represents municipalities, counties and government agencies with regard to their bankruptcy related matters. Mr. Glaser also represents corporate directors and officers concerning governance compliance issues.
In addition to lecturing widely on bankruptcy proceedings, Mr. Glaser has served as a delegate to the State Bar Convention on the title insurance litigation and Insolvency Law subsections, and has completed his eighth three-year term on the State Bar of California Insolvency Law Committee. He is a member of the California Bankruptcy Forum and was on the Education Committee in charge of the judges’ roundtable conference. Mr. Glaser’s active professional affiliations include service on the Los Angeles Business Council, the American Bankruptcy Institute (Member), the Los Angeles County Bar Association (Member; Legislative Affairs Committee Member), the American Bar Association (Member) and the Hawaii Coffee Association (Founding Member, Director and Legal Counsel).
Mr. Glaser has served as a judge pro tem for the Los Angeles County Superior and Municipal Courts since 1982, and served two terms as President of the Los Angeles Convention and Exhibition Center Authority. In addition, he was a member of the Board of Directors of Mothers Against Drunk Driving (MADD).
Mr. Glaser is a mediator for the 9th Circuit Court of Appeals and the Central District Bankruptcy Court. He has also handled matters from other bankruptcy courts throughout the state of California. He is a member of the Panel of Mediators for the United States Bankruptcy and District Court, Central District of California. He has served in this position for over twenty years.
Mr. Glaser has mediated over three hundred mediations and has received various acknowledgements from bankruptcy judges and district court judges. He mediates matters concerning civil law cases, district court cases and bankruptcy related matters.
Mr. Glaser is rated AV preeminent by Martindale-Hubbell, the highest rating for ethical and professional standards for over 25 years. He has also been listed as a Southern California Super Lawyer since 2005.
Representative Matters
Mr. Glaser’s experience has included the successful counseling of clients in the following representative matters:
Represented the HCA hospital chain and the County of Los Angeles in The Johns Manville Chapter 11 involving $1 billion of potential asbestos claims.
Acted as the partner in charge of a team of lawyers representing the resolution agent in the PMC/SLGH Ponzi Scheme case, including a portfolio of secured loans in excess of $350 million.
Represented Deutsche Bank concerning their secured debt in a hospitality Chapter 11 case involving hotel properties in four States
Represented five municipalities in the Orange County bankruptcy case.
Represented the County of Los Angeles Departments of DCFS and DMH regarding a provider of mental health services in a Chapter 11 Bankruptcy proceeding.
Represented the Los Angeles County Department of Public Works Water Division in the Ritter Ranch Chapter 11 Case. The case involved declaratory relief actions in the Bankruptcy Court and the California Public Utilities Commission regarding the water systems agreement and related matters. The case was settled shortly before trial affirming the County’s right to water-reliability and related fees in excess of $30 million.
Represented the County of Los Angeles in the Youth Intervention Program Chapter 11 case involving claims in excess of $4 million. The matter was resolved in mediation.
Represented the County of Los Angeles in the Tri-City Chapter 9 Case.
Represented the County of San Luis Obispo in the Los Osos Community Service District Chapter 9.
Represented the largest secured creditor (T-Mobile) in the Alert Cellular Chapter 11 in Santa Barbara.
Represented the County of Los Angeles in a multi-million claim dispute in the In re Santa Clarita, LLC, and In re Bermite Recovery, LLC, Chapter 11 cases in Phoenix, Arizona.
Represented the County of Sonoma in the Beckman TOT Bankruptcy related matters that resulted in a non-dischargeable Judgment in excess of $500,000.00.
Represented the County of Los Angeles and County of Alameda in the Palmdale Hills/Sun Cal – Lehman related bankruptcy cases that resulted in the Court Order that allowed the Counties the California R&T Statutory interest and penalty rates on their secured tax claims and exempted the Counties from application of Federal Discount Rate as required by the Confirmed Plans of Lehman.
Represented the County of Los Angeles County Treasurer/Tax Collector in the Tracht Gut LLC case before the 9th Circuit Court of Appeals. The Court of Appeals affirmed the lower courts in favor of the County and held that “The price received at a California tax sale” properly held under state law “conclusively establishes ‘reasonably equivalent value’ for purposes of’ the Bankruptcy Code’s (“Code”) fraudulent transfer section as “California tax sales have the same procedural safeguards approved by the U.S. Supreme Court in the BFP v Resolution Trust Corp case.
Represented the County of San Bernardino Treasurer/Tax Collector in Bankruptcy related matters and collected millions of dollars of tax obligations.
Recently mediated several 9th Circuit and Bankruptcy cases and received a letter from the Chief U.S. District Judge thanking me for my mediation efforts in resolving a very difficult matter. In addition, I recently resolved a major Bankruptcy Adversary case from the Northern District of California, pending for over a year that involved several parties.
Publications and Speaking Engagements
Mr. Glaser has lectured at numerous State Bar functions on bankruptcy related topics including the State Bar Section’s Education Institute in Santa Monica and the State Bar Annual Meeting in Monterey, California. Mr. Glaser was a featured speaker at several County Counsel’s Association of California Taxation Spring and Fall Study Section Conferences and the California Association of County Treasures and Tax Collectors Education Conferences regarding Tax issues in Bankruptcy proceedings.
Mr. Glaser’s publications have been published in the Los Angeles Business Journal ,the Turnaround Management Association Journal, National Business Institute (NBI), and the California Bankruptcy Forum, Education Committee.
Education
Mr. Glaser’s education includes post graduate work at the University of Kent, England. He obtained his Doctorate of Laws at the Southwestern University of Law, Los Angeles, in 1976, where he received the Bancroft-Whitney Award in Constitutional Law. His undergraduate work was done at the University of Copenhagen, Denmark and California State University at Northridge, California.
